Each year, Planned Parenthood publishes the Reproductive Rights Report to document Virginia legislator's votes on selected issues. You can use this report to get a general idea of how your legislators vote on reproductive rights. Please note that a legislator’s performance should not be judged solely on a few selected votes. Other factors to consider include public statements, performance in committees, legislation introduced, and constituent service.

HB 2808 Biased Counseling and Ultrasound Requirement (anti-choice measure), Patron: Del. Kathy Byron (R – 22, Lynchburg)
This bill required that every pregnant female be offered an ultrasound image of her “unborn child” before receiving an abortion. It also would have altered Virginia’s informed consent law by requiring women to receive ultrasounds 24-hours prior to the procedure. Currently, women who are traveling can have a same-day ultrasound. In Virginia, 32% of women receiving abortion services travel at least 50 miles. 10% travel more than 100 miles. Planned Parenthood opposed HB 2808. (House of Delegates: passed 60 – 38. Senate: failed in the Education and Health Committee 6 – 9).
 

HB 2797 Abortion and Birth Control Challenge (anti-choice measure), Patron: Del. Bob Marshall (R – 13, Manassas)
This bill defined constitutional personhood from the moment of fertilization. It would have granted the constitutional right to the enjoyment of life to “each born and preborn human being” from the moment of fertilization. It also would have undermined Roe v. Wade and some forms of FDA-approved contraception. Planned Parenthood opposed HB 2797. (House of Delegates: failed 45 – 52).

HB 1883 Targeted Regulation of Abortion Providers (TRAP) (anti-choice measure), Patron: Del. Bob Marshall (R – 13, Manassas)
This bill required any medical facility providing 25 or more abortions per year to comply with the regulatory requirements of an ambulatory surgery center. Ignoring all other medical/surgical procedures performed in physicians’ offices, this bill focused only on additional requirements for abortion services. Planned Parenthood opposed HB 1883. (House of Delegates: passed 60 – 35. Senate: failed in the Education and Health Committee 8 – 7).

Budget Amendment, Item 4.5-04 #1h Restrictions on Funding for Abortions (anti-choice measure), Introduced by Del. Bob Marshall (R – 13, Manassas)
This budget amendment further restricted state funding for medically-necessary abortions. It would have prevented doctors and the most vulnerable women in Virginia from having access to all medical options. Planned Parenthood opposed this measure. (House of Delegates: passed 66 – 28. The budget amendment was not included in the final budget as approved by the budget conferees).

SB 456 Birth Control Protection Act (2005) (pro-choice measure), Patron: Senator Whipple (D – 31, Arlington)
This bill defined contraception in the state code and protected birth control from Virginia’s abortion-related regulations (mandatory waiting period, state-scripted counseling, and parental consent). SB 456 was amended by removing a critical portion of the definition of birth control. This made the bill useless to protect access to contraception. Planned Parenthood supported the original bill but opposed the amendment. The patron ultimately pulled the bill after the unfavorable amendment was passed (Senate: amendment accepted 21 – 17).
